PollGPT provides an AI-powered platform for creating, distributing, and analyzing polls and surveys. Our Services include:

• Content Extraction: Create polls from URLs, PDFs, documents, and images
• Distribution Tools: Share polls via custom links, QR codes, and embeddable widgets

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice when possible.

• Host, store, and process Your Content to provide the Services
• Create backups for data protection purposes
• Display Your Content to authorized respondents

5.3 Aggregated Data

We may use anonymized, aggregated data derived from your use of the Services for analytics, benchmarking, and service improvement. This data will not identify you or your respondents.

5.4 Feedback

Any feedback, suggestions, or ideas you provide about our Services may be used by us without any obligation to compensate you.

6.1 Subscription Plans

We offer various subscription plans including free and paid tiers. Paid subscriptions are billed on a monthly or annual basis as selected during signup.

6.2 Billing

• Subscription fees are charged in advance at the beginning of each billing period
• All fees are non-refundable except as required by law or as explicitly stated
• You authorize us to charge your payment method for all applicable fees
• Prices may change with 30 days' advance notice

6.3 Free Trial

We may offer free trials for paid features. At the end of the trial period, you will be charged unless you cancel before the trial ends.

6.4 Cancellation

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLLGPT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8.3 Indemnification

You agree to indemnify and hold harmless PollGPT and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in Paris, France, except that either party may seek injunctive relief in any court of competent jurisdiction.

For users in the European Union, you retain any mandatory consumer protection rights under your local laws.
